We affirm Stone's conviction and remand for resentencing. Moreau's conviction is reversed. On October 26, 1973, a grand jury returned an indictment for possession of heroin against Davis Stone, Case No. 73-637 Criminal. That same day, a bench warrant was issued for the arrest of Stone. 2
